1. Scope of the Privacy Policy
This Privacy Policy serves to inform users about the nature, scope, and purposes of the collection and use of their personal data on the IT tenders platform, supplementary to § 8 of our General Terms and Conditions (GTC).
2. Principles and Definitions
We collect and use personal data of users of the IT tenders platform only in accordance with this Privacy Policy and pursuant to the General Data Protection Regulation (GDPR) and the Digital Services Act (DSA).
(1) Platform: Refers to the IT tenders platform and the services related to it provided by the operator.
(2) Operator: freelance pages AG.
(3) Tender: A request for proposal that can be viewed on the platform.
(4) Buyer: A company that publishes tenders on the platform.
(5) Service Provider: A company that is registered on the platform and receives notifications of tenders via the platform.
(6) User: An individual acting as an authorized employee of a company that registers the company as a buyer or service provider on the platform. A company in this context can also be a sole proprietorship or a freelancer.
(7) Matching Tender: A tender containing requirements that largely match the profile of a service provider.
(8) Matching Service Provider: A service provider whose skill portfolio largely matches the requirement profile of a tender.
Personal data of the user are data entered by the user when creating an account or profile on our platform or data related to the use of the platform by them if it is not company-related data.
Company-related data are those entered by the user when creating an account or profile on our platform and relate to a legal entity for which the user is acting.
3. Legal Basis, Type, Content, and Scope of Data Collection and Use
Personal data of users and company-related data are collected and stored only with consent and only to the extent necessary for the use of the platform and for billing the utilized services. The collection and use of personal data of the user are described below.
Personal data are stored exclusively on the operator's servers or on servers rented by the operator for exclusive use, to prevent external abuse or influences by third-party applications. Access to the data is limited to employees who need corresponding access rights to fulfil their respective tasks.
4. Process for Collecting User Data on the Platform
Registration on the Platform
During registration on the platform, personal data of users are queried. Only mandatory information is required for registration. Other information is voluntary. Voluntary information is desired by us as the operator to provide a better user experience for users, but not required.

The email address is used for correspondence with us as the operator in connection with the execution of the usage contract. All data transmission is SSL-encrypted.

- Preferred user language, to facilitate communication
- Telephone number (extension or main company number)
To issue invoices, we also require the address data of the service provider. These data are company-related but can also be personal in the case of sole proprietors or freelancers.
Profiles
Profiles are created by the user based on company data. Personal data are not required for this purpose. At the user's discretion:
- Data can be read from the company's website
- Company descriptions uploaded by the user can be used
With the help of AI, skills listed in these sources are extracted and their relevance for the profile provided by the user is determined, stored in a format allowing automatic matching of these skills with the requirements listed in tenders. Profiles are therefore not created by AI algorithms, but the user-provided profiles are evaluated using AI methods.
For service providers who are sole proprietors or freelancers, competency profiles can also be personal. In this case, by uploading profile data or initiating profile analysis based on the company's website, the user grants the operator permission to analyze the provided data using AI, even if the data are personal. If these data are in a language other than German or English, they also agree to the transfer of the data provided (company description or website data) to a non-European third country.
All personal or company-related data of service providers on IT tenders can only be viewed by buyers if the service provider applies for a tender from the buyer. Otherwise, personal or company-related data of service providers are not visible to third parties.
Tenders
Tenders posted by buyers can only be viewed by matching companies. These data are not visible to third parties. The project descriptions are processed separately from the personal and company-related data entered upon creation of the tenders and are submitted to AI algorithms for the extraction of contained requirements. The processing of these data takes place within Germany.
Payment Method Information
The payment method information (credit cards or PayPal accounts) requested by us is not stored by us but transmitted encrypted according to the PCI/DSS regulations to a payment service provider (PayPal Braintree) who handles payments for us. We only store the expiration date of the payment instrument and an identifier for queries to the payment service provider.
The data processed by the payment service providers include inventory data, such as names and addresses, bank data, such as account numbers or credit card numbers, passwords, TANs, and checksums, as well as contract, sum, and recipient-related information. These details are required to carry out transactions.

Additional Inventory Data Collected by Us as Operator
To effectively manage the platform, we collect and store additional data as a service provider if necessary. These include the date and time of the acceptance of the GTC by the user, the date of the last profile change, and the date of the last login on the platform.
Training of AI Algorithms
To optimize the AI algorithms developed by the operator, profile data is used only in anonymized form and detached from personal data. A reference to natural or legal persons is not possible based on these data.
5. Collection and Use of Usage Data
We log accesses to web pages by registered users to further improve user experience through additional optimization measures.
6. Limitation of Liability
The contents of this website are created with the utmost care. However, we do not guarantee the accuracy, completeness, and timeliness of the provided content. Use of the website's content is at the user's own risk.
7. External Links
This website contains links to third-party websites ("external links"). These websites are subject to the responsibility of the respective operators. We checked the external links for potential legal violations at the time they were first linked and found no legal violations apparent at that time. We have no influence on the current and future design and content of the linked pages. The setting of external links does not mean that we adopt the content behind the reference or link. Constant monitoring of external links is not feasible for us without concrete indications of legal violations, which we will respond to accordingly.

Right to Information

Right to Object
Users have the right to complain about unlawful data processing and may object to the use of personal data at any time by contacting or cancelling. This will be considered, and appropriate measures will be initiated, possibly affecting the purpose of data collection.
Right to Deletion and Correction of Data
Users can, at any time, by canceling their platform membership, cause the deletion of their personal data. The data will be deleted no later than the end of the current billing period (max. 1 month). Incorrect data can be corrected by contacting our customer service.
Retention Periods
The collected personal data are only stored as long as necessary for the stated purpose. However, the operator reserves the right to keep the data for an additional 14 days as a backup.
12. Amendments
The operator reserves the right to change these privacy provisions at any time. We will notify the customer of any such change three months in advance in writing, unless we are required by law to implement changes more quickly. The change is considered agreed if the customer does not object in writing within six weeks of receiving the notification. If the customer objects, the operator has the right to terminate the contract with effect at the end of the current calendar month.
